Terms and Conditions of the contract on the rental of a MotoReggi.

The recruitment of the rental of a scooter, the/drivers/is recognized as/n you have read and accepted the terms and conditions detailed in this paper.

Through recruitment, the drivers are committed to uphold at all times the traffic regulations in force and take responsibility for the few sanctions could arise from the use, misuse or non-compliance with legislation and during the term of this contract.

Are NOT included, the own damage generated by the driving reckless and/or negligent, as well as driving under the influence of Alcohol or Drugs. Any of the reasons set out herein, exempts the company from any and all liability for damages incurred with our scooter.

The terms of the rental contract, and may only be modified by express agreement, in writing and signed by both parties. The company reserves the right to cancel bookings based on the criteria prior notification to the customer as well as the right of admission.
In case of any violation of the conditions outlined in this agreement, Motorcycles Reggi may terminate this agreement at any time to demand the immediate return of the vehicle at our premises in Ciutadella and does not proceed to any refund of the amount paid.

ARTICLE 1 – REQUIREMENTS FOR THE RENT
Experience minimum 3 years of driving, as well as experience in the management of the same. If at the time of delivery, the operator of Reggi perceived that the client will not know to ride the bike, do not proceed with the delivery of the same and will not return the payment made.

We will not accept photos, photocopies, or complaints and/or any other document that is not in the driver's original. In the event that the Customer does not meet the above conditions will not proceed to deliver the vehicle or to return the amount paid.

ARTICLE 2 – PICK-UP AND RETURN OF VEHICLE
The Customer receives the vehicle in perfect working condition and with accessories (keys, helmets and original documentation). You should check together with the person in charge of handing over the bike; recognizing stay informed of the type of fuel that the vehicle's accurate; and promising to return the vehicle in the same conditions in which you received, the customer has one hour after the date of hire to detect any abnormalities of the bike.

The Customer undertakes to return the vehicle to Bikes Reggi in the date and time and at the place agreed in the rental contract, and may vary as long as the new location gavest not thou of 10 kilometers or more and the customer to notify you with a minimum of 24 hours in advance.

If for reasons beyond our Company, the Customer does not collect the vehicle at the time provided in the booking or hiring we will not extend the contract, or pay the hours or days not consumed.

ARTICLE 3 – REQUIREMENTS FINANCIAL
In addition to the price of the reservation, if estimated by the operator who will carry out the contract, the rental of a bike will require a deposit or bail. All of our rentals include basic insurance to third parties, without charge to the rent.

Deposits paid are:

· Kymco Agility city 125 - 150€
· Symphony SR 125 - 150€

In any case the deposit will be useful to an extension of rental. The payment of the deposit must be made by credit/debit card or cash and will be returned the same way to the paid (In the case of which it has been paid for by credit card and the rental period greater than 28 days may not be returned by crediting the card. The expenses of the bank wire transfer for your return to be borne by the Customer.) This amount does not cover the total of the alleged damages, assuming that the damage to the vehicle exceeds the amount of the bond shall be paid by the Customer. When the Customer returns the vehicle along with the keys and the Company terminated the agreement, it shall return the deposit.

ARTICLE 4 – THE INCIDENTS AND THEFT 

In case of accident or theft, the customer has the obligation to contact the Police and make the relevant allegation of the theft within 24 hours after the incident. In the event of an accident with another vehicle, the Customer shall submit to Bikes Reggi within 48 hours after the incident, the friendly party, completed by the two parties or the attestation of the Civil Guard.

In the case of total loss of the vehicle, being the driver responsible whatever the reason of the accident, the company reserves the right to bill/charge the customer a minimum, 80% of the market value of the motorcycle at the time of loss because they are vehicles, pre-owned, and so it notifies by these terms.

In case of theft, you must submit the complaint, and the keys of the vehicle.

In the event that, for a defect, the vehicle suffers a breakdown and not an accident, Motorcycles Reggi he will be replaced by the vehicle as soon as possible, we have road service 24hrs. In case that is not possible, a replacement of the vehicle, Bikes Reggi will refund the amount corresponding to the days not enjoyed the contracted rate and get you closer to your place of lodging.

The Client acknowledges and agrees expressly set forth in the preceding paragraph, and waive any compensation where appropriate.

The Driver/Customer is responsible of the vehicle and the damage caused during the rental, unless the Lessor to obtain the acceptance of the responsibility in whole or part by a third party.

In the event of an accident is not there to replace the vehicle, remaining completion of the contract and not return the money for the remaining days of the rental.

The damage which the customer may generate will be subject to valuation of the company and subsequent budget by the Landlord. This implies that you can not return the damage deposit until it is certified with a provisional budget of the value of the repair.

ARTICLE 5 – FUEL
Rate Full – Empty: Bikes Reggi will deliver the bike to the Driver with a full tank. The Customer must return the bike as it deems to be aware that you will not be reimbursed any amount in respect of fuel.

Rate of FUEL according to the model:
· 125cc - Combustible: 15€

All of our bikes use gasoline 95 unleaded. If there is any error in the filling and as a result the bike suffered some damage, the repair shall be borne entirely by the Customer.

ARTICLE 6 – MAINTENANCE
The Client is unable to repair the vehicle without prior written authorization by the company. The maintenance and lubrication of the vehicle are included in our rates. (Not including flat tires and/or tire changes arising from misuse of the vehicle.)

The mechanical wear due to use of reasonable and normal of the vehicle is assumed by Bikes Reggi. The Customer is obliged to stop the Vehicle when it detects any abnormality in operation of the Vehicle. The Customer should contact Bikes Reggi 680 91 68 54 or 615 94 09 70. In case of damages to the vehicle, as well as their accessories and add-ons, and/or theft of the same, shall be made on the appropriate charge to the Customer for the following items and amounts:

ARTICLE 7 – ROADSIDE ASSISTANCE
The Service of roadside Assistance is included in the rate if the damage is to own the bike, in the event of an accident, negligent or stoppage of the vehicle by the part of the authorities, the cost of attendance is $ 100 in the case of the bikes. It is strictly prohibited the parking of the vehicle on roads, trails and areas where the vehicle might suffer damage or hamper the circulation.

ARTICLE 8 – RULES FOR THE USE OF THE BIKES
The Customer undertakes to use and drive the vehicle in accordance with the basic rules of driving, circulation, and according to the specifications of use of the vehicle and with the greatest possible care, in the Bikes Reggi we take care of our fleet. The Customer is strictly forbidden from taking of Minorca the rental vehicle Bikes Reggi. You are only authorized to drive the vehicle to the person or persons identified and accepted by Bikes Reggi in the rental contract, provided they have a minimum experience of 3 years and they own and are in possession of a driving licence, valid and in force.

The Customer agrees to park the vehicle in a safe place and properly parked when not in use. Customer shall not assign, rent, mortgage, pledge, sell, or give as a warranty on the vehicle. You are prohibited to vary any technical characteristic of the vehicle, or make any kind of modification of its exterior and/or interior (unless authorized in writing by Motorcycle Reggi).

You are not allowed to transport the vehicle's onboard any type of vessel, truck or means of transport (except express written permission of the Landlord). In the case of a Fine, the Customer is liable and shall pay the same as soon as possible. If it were the case that the Customer will result in forfeiture of the vehicle, the charge for collecting the same in the municipal compound will be indicated in the invoice issued by the local administration.

ARTICLE 9 –CANCELLATION AND REFUND OF THE CONTRACT.
In the event that the Client wishes to cancel the reservation, you must communicate with Bikes Reggi, we know that each case deserves our attention.

Rules and policies cancellation: For a full refund of the booking, the client must give a minimum of 5 days prior to the date and time of delivery of the motorcycle. In the case of be found within the deadline, we will proceed to refund full or proportional to the money previously paid by the Customer. The refund, if applicable, will be done in the same way that has been paid by the booking. In the event that the cancellation is made 4 or 3 days in advance, will not be refunded 100% of the amount to the following details:

ARTICLE 10 – EXCLUSION OF LIABILITY
Bikes Reggi not be held responsible for rentals rejected by the lack of documentation and/or requirements necessary for conduction. Of the impossibility of giving the Service or allow access for any reason beyond Bikes Reggi.

ARTÍCULO 11 - RECLAMACIONES
En caso de que el usuario desee presentar alguna reclamación a Reggicenta SC, podrá remitir una carta a nuestra sede central en Calle d'Osca, 5 Baixos. CP 07760 Ciudadela de Menorca, Islas Baleares, España o solicitar nuestro libro de reclamaciones.

ARTICLE 12 – APPLICABLE LAW AND JURISDICTION
The present General Conditions are governed by the Spanish Legislation, which will be applicable in anything not stated in the same in terms of interpretation, validity and execution. The parties expressly submit to the courts and tribunals of Ciutadella de Menorca to settle any dispute that may arise in the interpretation and/or execution of these General Conditions of Recruitment.

ARTÍCULO 13 - CONDICIONES PROTECCIÓN DE DATOS
Mediante la firma y /o suscripción con Reggicenta SC el cliente acepta las condiciones generales descritas en el presente escrito y acepta haber sido informado de que los datos personales que nos faciliten, serán incorporados al fichero “Clientes” de nuestra empresa, debidamente inscrito en el registro General de la Agencia Española de Protección de Datos, que cumple con las medidas de seguridad estipuladas en el RD 1720/2007 de 21 de Diciembre, y cuya finalidad es la gestión de los clientes de la empresa, elaboración de su facturación y envío de información comercial de nuestros productos y servicios.
